Mr. Moran is a surety and construction attorney with experience in many practice areas, including real estate, commercial litigation, personal injury (plaintiff and defense), toxic torts, petroleum franchising, business litigation, estates and trusts, bankruptcy, attorney malpractice, social security, judgment enforcement, and church law. Mr. Moran’s legal expertise extends to the areas of establishment and enforcement of mechanic’s liens, and complex construction litigation.
His surety practice encompasses complex multi-project performance bond claims, payment bond claims, estate bonds, motor vehicle dealer bonds, mortgage broker and lender bonds, title insurance settlement agent bonds, and other statutory bonds.
Represented a major national manufacturer of gaskets and packing material in numerous asbestos tort claims.
Successfully represented a plaintiff in a legal malpractice action involving land use and the claim of a condominium association.
Successfully represented a former motel owner in a breach of contract dispute with his partner.
Obtained dismissal of a third-party surety bad faith claim brought by a plaintiff who had allegedly been injured by a mortgage broker in West Virginia, which was upheld on appeal to the United States Court of Appeals to the Fourth Circuit.
Worked closely on appeals to the Supreme Court of Virginia, Virginia Court of Appeals, United States Court of Appeals for the Fourth Circuit, Supreme Court of Appeals of West Virginia, and Supreme Court of the United States.
Currently represents numerous sureties in claims involving construction payment and performance bonds, motor vehicle dealer bonds, mortgage lender and broker bonds, title insurance settlement agent bonds, landfill bonds, and subdivision bonds, among others.
Tracked down, encumbered and executed on an inheritance owed to a surety’s principal, resulting in a substantial recovery for a surety that had suffered heavy losses under construction payment and performance bonds.
Successfully defended a national furniture and electronics retailer against a customer’s fraud claim.
Successfully represented construction contractors in contractual claims and mechanic’s lien litigation against public and private entities.
Successfully represented beneficiaries under a living trust after trustee failed to properly disburse income to them.
Obtained a large settlement in a wrongful death claim for the family of a truck driver killed due to the negligence of an unidentified motorist.
Represented a dealer of manufactured homes in an appeal of an adverse regulatory decision.
Represented government agency in dispute over contract to renovate a House of Representatives office building in Washington, DC.
