On September 16, Gov. Terry McAuliffe declared a state of emergency in order to allow for a state response to prevent gasoline shortages following the temporary shutdown of Colonial Pipeline's main lines in Shelby County, Alabama. The declaration waived certain state and federal regulations limiting the number of hours motor fuel carrier drivers can drive per week for carriers transporting gasoline. Today, several state agencies issued additional waivers authorized as part of the Governor's Executive Order. DMV has temporarily waived registration and licensing requirements and the Commissioner of Highways has temporarily waived normal weight and width restrictions on roads controlled by VDOT (this does not include interstate highways), subject to certain limits specified in the waiver notice. These waivers are for the express purpose of preventing any potential resource shortages or fuel supply disruptions caused by the Colonial Pipeline situation. The waivers are effective beginning 12:00 a.m. September 20, 2016 until 12:00 a.m. October 5, 2016. The exemptions in Section 390.23 of the Federal Motor Carrier Safety Regulations association with relief from the hours of service regulations is still in effect. The waiver only pertains to statewide shippers and carriers directly associated with transporting gasoline and petroleum products. We recommend that your drivers carry a copy of the official waiver notice in their trucks whenever they are utilizing the waivers authorized by this declaration.
