Mr. Mackey’s practice areas include personal injury defense, railroad defense, general litigation, insurance defense, premises liability, contract disputes, insurance coverage disputes, commercial landlord/tenant law, and transportation law. His experience includes civil defense representation of clients in both state and federal court for claims brought pursuant to state common and statutory law, including claims arising under theories of ordinary negligence, negligent hiring, negligent retention, breach of contract and breach of implied covenants, as well as direct actions against insurers for failure to settle within policy limits and/or in good faith. In addition to defense of claims arising under various state laws, Mr. Mackey’s experience also includes civil defense representation of clients in both state and federal trial and appellate courts for claims brought pursuant to federal law, including Title II of the Americans with Disabilities Act, the Federal Employers’ Liability Act, Locomotive Inspection Act and whistleblower claims under the FRSA and STAA (Surface Transportation Assistance Act).
Mr. Mackey graduated Cum Laude with his bachelor’s degree in Business Administration from Western Washington University in Bellingham, Washington. He received his Juris Doctorate from the Marshall-Wythe School of Law at the College of William & Mary in Williamsburg, Virginia. While in law school, Mr. Mackey received Honors in Legal Skills II, III & IV for excellence in research, writing, analysis, trial and appellate practice, and client relations, and was a recipient of the Legal Scholars Award. Additionally, Mr. Mackey represented his law school as a member of the William & Mary Moot Court and National Trial Teams, successfully competing in multiple trial and appellate advocacy competitions across the United States. Prior to joining Setliff Law, Mr. Mackey served as a judicial extern for the Honorable LeRoy F. Millette, Jr. of The Supreme Court of Virginia and has worked as extern/intern for a number of government entities including: Transportation Security Administration, Department of Labor, Office of the Attorney General for the Commonwealth of Virginia, and Norfolk Commonwealth Attorney’s Office.
Outside of practicing law, Mr. Mackey enjoys an active lifestyle, engaging in nearly any sport that involves a ball, as well as spending time with his friends and family.
